Legal Question in Personal Injury in Idaho

I was in an high-speed accident with another vehicle and my aie bags did not deploy. I suffered a broken nose and a concussion during the impact. The dealer whom I bought my 2001 truck from assured me that the airbags were functional, can I qualify for a settlement?

You probably have a claim. The problem with these types of claims is that the remedy is so difficult to obtain. You usually have do a lot of things to get an auto manufacturer to pay on something like this, and the damages have to justify the expense of pursuing the claim. It is possible that you may have a remedy against the dealer, but it is tough to know that without getting deeper into the case.

Other factors could include if this was a front-end collision or not. If it was high-speed, but not a front end collision, the air bags probably would generally not deploy.

So.... you probably have a claim against the manufacturer and possibly the dealer, but it may not be worth pursuing, since fortunately your damages are fairly low, it appears. The costs of pursuing that kind of case are fairly prohibitive, usually.

If the collision was not your fault, you would certainly have a claim against the other driver, and that would be worth pursuing. Feel free to check back with me if you have other questions.
