my baby was in danger what can i do?
I rented from my landlord for 2 years after one year our electric system stared to over heat and blow fuses. when this happend. the walls would get verry hot and smell lik eit was burning..it is and old system..we had 3 repair guys say it needed to be upgraded and after 3 months he still did not have this done... we have now moved and because he would not fix it and it was putting my 1 month old in danger. what can i do about this not that i hve moved..we have only been moved for about one week???
please help...

Why are you asiing this question now? You had the right under Idaho Code section 6-320 to file a 3 day notice to have him fix the problem. If he didn't fix it within the 3 days, you would have been entitled to sue to force him to do so and could have collected 3 times your actual damages. Now that you have moved you are no longer a tenant and you cannot sue him under this statute.
If you suffered damages, you can probably sue him for failing to provide you with habitable premises and recover any actual damages you suffered. However, you would have to prove that you notified him of the problems, that he failed to remedy the problem, etc. However, the questions you will be facing is why you didn't file a 3 day notice under the statute.
