My mother passed away leaving no will. She owned a home she was paying on. My neice was living with her at the time. Can my neice continue living in the home as long as she makes the house payment?

You need to file probate and ask to be appointed personal

representative (PR) who can make arrangements for your

sister to live there and continue making payments and upon

what additional terms may be appropriate.

..........However, she can live there anyway until such time

as the tax people or someone else discovers what is going on and

either stops it by foreclosing, etc. If the mortgagee finds out that

the person they loaned the money to to buy the house

in the first place has passed away, they might go ahead and foreclose on

the house. the safest way is to file for probate of the will
