POA fraud

After my mother's death we review all of her accounts and we documented over $120,000 in funds that were removed from her account by the POA: purchase of a home, house payments, donations, living expenses for POA. What recourse do we have as beneficiaries of our mother's trust to re-coop these funds?

Depending upon the relationship of "POA" and your Mother the POA may have valid defenses to an allegation of breach of fiduciary duty. However, if you feel as though the POA clearly breached his/her fiduciary duty you should pursue the matter further by speaking with an attorney.

You should file immediately before the assets are wasted or hidden. There is no defense to purchasing personal items from a principle's funds. Contact me directly.
