probate

me and stepbrother applied for probate he applied to probate my dad and his mom together{i was never notified}

i applied for my dads probate. in his application he lied that he was thier only child and thier were no other hiers except him. the judge said i should formally probate but i cant see the point if he has already taken and sold everthing. is thier a form or whatever i can or should send to the judge stating this .shouldnt his app. be thrown out. or at least can i make him account for what happened to the estate? thankyou!

You certainly appear to have a right to demand an accounting from your stepbrother but you will have to bring an action to do so. You will incur legal fees and expenses so you have an issue as to whether it will be worth it. You certainly should file a written objection to the probate in the file that your stepbrother began.
