Legal Question in Real Estate Law in Illinois

We are building a house with a local builder. We just discovered after the foundation was poured that the dimensions on the sunroom are not accurate - actually one foot short in the width. The builder insists that the dimensions given were exterior not interior. The rest of the house dimensions given were for the interior. We are insisting that they fix this problem or we are walking away. In checking with others in the community, we found their sunroom measurements were accurate. Where do we go from here and what are our rights. What does the law say about dimensions given on a house plan?

In order to let you know what your options may be, I would have to review your contract with the home builder. If in fact, the measurements are based on interior dimensions, then you may have a cause of action. My firm handles these types of matters and if you are interested in exploring this matter further, please feel free to contact me.

Thank you.
