DRUG Charges

My son was arrested for possession of 15 grams cocaine and one pound of pot. He is 20 years old and this his first time of ever being arrested for anything. He checked himself into rehab on his own and has done really good with the program. Is there any chance he may be able to avoid prison time?

If your son was charged with possession of a controlled substance of 15 grams or more, he's facing a "Class X" felony. The punishment for that is 6 to 30 years in prison with no probation possible. My advice to you is to hire an EXPERIENCED criminal defense lawyer. He/she MAY be able to negotiate the charges down to a lesser class felony. There are no guarantees of that. If you already have an attorney representing your son then this is something you should discuss in great detail with that attorney. I will say that there is always a possibility of avoiding prison. Sometimes, a defense lawyer is able to defeat the charges with appropriate Motions, or at the probable cause hearing, or at trial. Other times, it is possible to negotiate a plea bargain with the State's Attorney (prosecutor) which the Judge will approve. In some cases, the defendant's cooperation might be an important factor. In all cases, the jurisdiction you are in will greatly influence the outcome. Individual prosecutors and judges handle these matters differently. There are many factors which will come into play with your son's situation, and it is impossible to do much more than allow you some reasonable hope that he will avoid prison. Everything definitely does depend upon your getting the very best criminal defense attorney you can afford. Personally, I have handled a wide variety of drug cases in courts throughout Illinois, and I would be willing to speak with you or your son if he is not already represented.
