Legal Question in Construction Law in Illinois
We have a signed contract with a homeowner to provide kitchen cabinetry for $ 20,000.00 which we have done. The builder of the home has only ran $ 11,000.00 through the title company and has told us that the balance of the $ 20,000.00 will be paid directly from the builder because the homeowner went over their budget. (We have this information in writing.) We have signed a final waiver for the $ 11,000.00 through the title company and are now having problems getting paid through the builder for the remainder. If we do have to get an attorney, does signing the final waiver for the title company cause issues (legally) in going after the builder for the rest of the money? Thank you!
