proof of service

In Illinois is is valid to have a paralegal's signature on a proof of service? The motion was also signed by the attorney with just the paralegal signing the pos.

Re: proof of service

Under Illinois Supreme Court Rule 12, proof of service is properly supported "by certificate of the attorney or affidavit of a person other than the attorney."

This means that a paralegal can sign a proof of service, so long as the signed document includes a sworn statement that the facts put forth in the proof of service are true and correct.

The affidavit can come in many different shapes and sizes, but is commonly accomplished with a "Verification by Certification" under the Illinois Rules of Civil Procedure, Section 1-109.
