Legal Question in Banking Law in Illinois
Cashier check cashed by wrong person
I gave a cashier check payable to a company as a down payment to buy a property. contract fell apart. seller took too much time but never refund that money. now after one year he is telling me that he never got that check. some one else deposited in his personal account. When I went to bank they told me its more than a year we can't do any thing. its bank's fault, they should not owner this check to other people. Because of this I lost my home. What should I do? Can I sue the Bank?

Re: Cashier check cashed by wrong person
Hello. I would investigate further the seller's claim that he never got the check. If he never got the check, chances are the seller would have told you this in the beginnging. Sounds as if you may have to file a lawsuit against the seller. I will be happy to discuss this further and in more detail.
