My legal position as a factoring company collector
What are my legal rights as a collector following the fair debt collection act, thus to avoid any legal troubles for supposed violation of the FDCA ?

Re: My legal position as a factoring company collector
The Fair Debt Collections Practices Act is a tricky thicket to work through. Any small non-compliance can result in automatic liability.
As someone who has litigated FDCPA claims, I would suggest strongly that any collector retain an experienced FDCPA practioner to draft model collections (i.e., dunning) letters and other materials that fall within compliance of the FDCPA, as interpreted by federal courts within the jurisdiction of the collection agency.
