The Illinois Safety Deposit Box Opening Act provides specific procedures for opening a safe deposit box where the last of surviving joint owners has died. The exact procedure depends upon a variety of facts. Without knowing your specific facts, rather than make assumptions about your situation or discuss all the possible scenarios under the statute, I suggest you look at the statute and find your answer there based on your own situation.
