Legal Question in Bankruptcy in Illinois

i am a 2001 phi theta kappa graduate of an accredited private junior college which offered an associates degree in applied science (court reporting). at the time of enrollment, the school said they were offering a new "theory" which would revolutionize the court reporting field by allowing us to write in "real time". well, long story short, two graduating classes were taught this theory in which we had to stroke out every syllable in order to produce a real time ready transcript. when we graduated with the "supposed" requirements needed to pass the mandatory Illinois court reporting exam, the school tricked us by giving us tests that were timed by syllable, whereas the state exam uses a word count (word for word). we were totally unprepared. only 2 girls in 2 years passed the state exam. i would like to sue them. myself and a lot of the other girls owe a lot of money in student loans. as an alternative, i would like to know if we are eligible to file bankruptcy and include student loans as we are not able to practice in the profession for which we were so inadequately trained.

I don't know what PTK is, but, I'm sorry that your educational experience was not all that you thought it might be. It is most probable that you would lose a law suit against the private college. Really, there are so many variables involved, and unstated by you. Whether a student loan can be discharged in bankruptcy also involves variables, chiefly whether the feds were involved in the loan. Good Luck! Please consult a bankruptcy attorney, and bring ALL the loan docs with you to your first meeting.
