Legal Question in Bankruptcy in Illinois
Affect on ex-spouse if I file for bankruptcy
I am considering filing for bankruptcy; however, I have several joint credit cards with an ex-spouse that I would want to include if I file. If I file for bankruptcy and she does not, can I include the total debt from the joint credit cards? If I can, will it affect her credit (i.e. will the discharged debt be included on her credit report)?
Please advise. Thank you.

Re: Affect on ex-spouse if I file for bankruptcy
The debt will only be discharged as to you, and she will still owe the credit card, and there is the issue of what does your divorce decree say about that credit card debt. You need to take your divorce decree in to see a bankruptcy attorney to be sure that you can easily discharge that credit card debt.
