Legal Question in Bankruptcy in Illinois
Bankruptcy question
My son is in the process of a divorce and is trying to declare bankruptcy. He saw the attorney yesterday and they told him he will have to pay back $400 per month because he makes too much money. That sounds like the new bankruptcy law and I thought that wasn't in effect yet. Also, his main expense is his home and I thought if you gave that up you just walked away from it. Thanks for your help.

There are a lot of facts missing from your message. Perhaps the first thing to say is that "alimony" and child support obligations are not dischargeable. I would be pleased to speak with you and your son in my office if this a Kane or Du Page County case. If not, you should speak to a competent bankruptcy lawyer in your area.
