Legal Question in Bankruptcy in Illinois

I am currently in a chapter 13 bankruptcy that will be completed in 4/2013 and am current and have had no issues. Recently I had wrong site surgery but am hesitant to take legal action because I don't know whether or not the courts would take all of the settlement...I also work at the hospital so if I am not going to benefit from the legal action I am not sure it is worth it. I live in IL-McHenry COunty. Thanks you
