Legal Question in Bankruptcy in Illinois

chapter 13

Can I lose my home? I am four months behind and have the mtg. for two months but, the mtg. won't let me pay the two months? They want the total four months! I want to save my home. My wife is dying of Bone Cancer and I don't want to have to take her out of her home at this time.

The goal in a chapter 13 is to not lose your home but if you cannot keep up with the Chapter 13 payments and catch up on the arrearages, then yes you can loser your home. You need to consult a chapter 13 attorney. Four months behind isn't too far behind, you have time to plan accordingly (especially if they haven't filed foreclosure proceedings yet).
