Legal Question in Bankruptcy in Illinois

I am gonna have to file bankruptcy soon, I am over 40,000 in debt. I have two maxed out credit cards i was gonna put on my debts to file. I am unemployed working part time at a restaurant for minimum wage, one of my credit cards is only a few months old but i maxed it out to try to cover my bills, also will the newness of the credit account and the fact that its past due in payments cause a problem when filing for bankruptcy?

Very good question.
It is wise to be concerned about the recent usage on the credit cards. Under the bankruptcy code, debt incurred within 90 days of your filing is considered presumptively non-dischargeable.
