Legal Question in Bankruptcy in Illinois
a creditor
My bankruptcy was discharged 5 years ago. In it a small loan was for 2000.00 was not listed on the list of creditors. Is this not automatically included via a precedent of some sort? (Mendez case?)

Re: a creditor
If you filed before the law change that occurred in October, 2005, in Illinois, there is caselaw, In Re Mendiola. This states that if a debt was inadvertently left off the bankruptcy case, the debt would be discharged anyways.
