Legal Question in Bankruptcy in Illinois
If your debt is just over 60 days old and some included cash advances, will this
I am an unemployed divorced mother of one. My only source of income is child support. I have accumulated debt on Credit cards totalling about $12,000 dollars. Some of this was transferred to my card from an original joint card with my ex-husband. About $3,500 of the money owed was from cash advances, over 60 days old. Can I file for bankruptcy and will all of the charges over 60 days old be paid? My credit cards are in my name only, not my ex-husbands. Thank you for your time.

You can certainly file for bankruptcy protection and discharge of your debt.
You should call me or another bankruptcy lawyer as soon as possible to avoid problems with your creditors. Please know that as soon as you file a petition, you will have the protection of the Automatic Stay provisions of the Bankruptcy Code.
Good luck!
