Legal Question in Bankruptcy in Illinois
filing bankruptcy
If your credit is in good shape and you have a judgement entered (1984 debt) for triple the amount (interest) can you file bankruptcy and notify all other creditors that they are not included thereby only claiming that judgment? If you file and own a home and you are not behind and will not include the mortgage, credit card and car note, how does this affect your credit and are you allowed by law to do this?

Re: filing bankruptcy
No, if you file bankruptcy, all creditors are included. I would check to see if a judgment on a 1984 debt was still valid under your local statute of limitations.
