Legal Question in Bankruptcy in Illinois
I am filing chapter 7 bankruptcy and I have an account with a workmens comp settlement in it. I have been unemployed for two years and it has been my income basically while I go to school. Can the court take that from me?

Your attorney should advise you before filing your case. To the extent you have segregated those funds, making them clearly traceable to the workers' compensation settlement, they should be exempt under all recent interpretations of Illinois law. At least one bankruptcy trustee has expressed that the interpretation should be challenged, but it seems to me that is unlikely.
