These are 2 separate issues. Usually, if you are using a Chapter 13 Plan to save your home you do not need to spend any money on Foreclosure defense. The Foreclosure action automatically stops when you file the Bankruptcy action. The maximum fees allowed to be charged by the Court in Illinois are $3,500 attorneys fees and approximately $400 in court costs etc. for a married couple. An attorney usually requires about $1000-1500 down payment and then the balance is put in the bankruptcy plan and paid over the 5 year period.

If you want to give up your home it may be worth it to spend some money on foreclosure defense so that you can live in the property for a longer time. Foreclosure defense is usually handled on an hourly basis. We will discuss all this with you in a free consultation.
