Legal Question in Bankruptcy in Illinois
Foreclosure
The mortgage company is attempting to foreclose on my property. I have previously filed Chapter 13 to save my house. That plan was dismissed because my payments were behind. Now the mortgage company has filed another foreclosure action against me. Can I file another Chapter 13 to save my house.

Re: Foreclosure
Yes. You can file a Chapter 13 or a Chapter 7. The issue is why you fell behind your payments in the first Chapter 13. Perhaps a Chapter 7 is the better option.

Re: Foreclosure
Yes, you can file again. In some states the Trustee will object to repeated filings right before a foreclosure. I would suggest you make sure and propose a chapter 13 plan that is reasonable so that you definitely make your payments. Please feel free to give me a call to personally discuss your situation in more detail. ph. (800) 303-0720
