Legal Question in Bankruptcy in Illinois
Home equity reaffirmation attorney fees
My wife recently had her bankruptcy discharged and during the bankruptcy the credit union who holds the home equity loan on our house and a personal loan, had a lawyer draw up a reaffirmation agreement and attend the creditors meeting. We still have not signed the agreement because they keep trying to add the personal loan into the reaff. Now they have added their attorneys fees totaling $2000 onto our home equity loan. I have a feeling they are charging us for the work the lawyer did on the personal load as well as every time they sent an incorrect reaff. Can they legally hold us responsible for these fees? We have been making payments every month, even through the bankruptcy, and have not missed a single one.

Note, however, that if this case is not in Du Page or Kane county, you should call a lawyer who does BK work in the county in which the case is pending.
