Legal Question in Bankruptcy in Illinois

i think i need some help

ok the house i am living in is currently under a chapter 13 bankruptcy.this was not filed in my name.i have a conmsiderable debt that i am having trouble repaying and need to know if me filing a chapter 13 is ok for debt since the house is currently in a chapter 13 but not in my name.i have never filed a bankruptcy before

If you don't own the house, you would not have to list it as property in your petition/schedules.

Short answer -- You should probably file under Chapter 7 and eliminate all of your debts.

The house should not be an issue since you do not own it. Are you renting the house or living with the person who owns it? Basically you would list the amount of rent you pay as part of your monthly expenses. I recommend you file your case under Chapter 7 and "discharge" (bankruptcy term that means eliminate) your debts. A chapter 13 case can last up to 5 years and a chapter 7 case lasts only about 5 months.
