Legal Question in Bankruptcy in Illinois
my husband and i bought a home but only he was on the loan. at the closing, i believe i signed a homestead rights waiver. Our home is now in foreclosure and my husband refuses to file bankruptcy. Am i able to file bankruptcy in order to possibly keep the home or will he have to do it?

Are you being sued as well? I noticed that you are in Kankakee. I'm much further north. You need the advice of an attorney in your area. Soon. If you don't have/know a lawyer, call your local bar association. Again, don't wait!
