can the IRS sieze tax return funds for back child support after the said support

Can the IRS sieze JOINT TAX RETURN REFUND monies for back child support that has been included in a Chapter 13 filing. My current husband filed Ch 13 in May 2001, we were married December 2001. My income was 90% of the entire return that we filed, and my new husband's child support arrearage was included in the Ch 13. Since the STATE entities DONT COMMUNICATE, we just found out that our entire refund has been siezed... Can you HELP??

You should immediately speak to your bankruptcy counsel about this problem. Even the IRS is not immune from the bankruptcy court's jurisdiction. Good Luck! The action of the IRS may constitute a violation of the Automatic Stay provisions of the Bankruptcy Code.
