Legal Question in Bankruptcy in Illinois

Married but unemployed

I am recently married and unemployed. My husband earns a good income, however, all my debt is in my name only and occured before we were married. I have no assets. Can I file Chapter 7 or 13?

You may be able to file individually, but your husband's income and expenses will be counted for the budget test -called means test. This test will determine what chapter will be best for you. If you wish for a free consultation to determine your options, please contact me. Thanks.

Re: Married but unemployed

You may opt to chose one or the other, however a much more in depth consultation would be necessary prior to me being able to give you a proper answer to this question.

I would need to know

1) the type of debt owed

2) do you own a home, or plan on purchasing one in the future

3) why are you chosing to file for bankruptcy if your income is good

and several other questions I would like to personally as you.
