Legal Question in Bankruptcy in Illinois
Do you have to notify your auto insurance company if you go through a bankruptcy and/or foreclosure or can they just find out through background checks?
Also, if a foreclosure is processed through (so the house is given up through) a bankruptcy, how do you stop bills? For example, can you just call the electric and water companies and stop the electricity and water and stop paying it if you don't live there anymore but the foreclosure is not 100% complete? Because, what if you cancel the water and the pipes freeze over the winter...is that your responsibility still even if your house is going through a foreclosure?
Lastly, are you notified of when you have to leave the house or are you spontaneously kicked out? Do they warn you / notify you through mail?
1 Answer from Attorneys
1. You do not have to advise your auto insurance company
2. Bill stop automatically in bankruptcy otherwise they keep going until you close the account
3. After you move out it can be a legal gray area...you are still the owner of the house.
4. They need to use legal process to remove you from the house.
