Legal Question in Bankruptcy in Illinois
who pays
we are talking a divorce. if we do get one and the different loans are split between us, we both signed for these and the person that was ordered to repay the loan, then files banckruptcy on that loan , can the other party be held responsible and have any rights to go back to court against them?

I would suggest that you file a joint bankruptcy prior to obtaining a judgment for dissolution of marriage.
