Legal Question in Bankruptcy in Illinois
services and goods not delivered
could you put a lien on the owners personal property of a company that cashed a check of mine knowing that their company was going to file Chapter 7? This co. cashed my check that was suppose to pay for some kitchen cabinets. The company is owned by two brothers.
I was told that they are ''going'' to file CH 7 and that the chances of me receiving any of my money back is slim and none. To me this seems like flat out theft!
Thank you

Well, you would have to file a petition in bankruptcy court, the cost of which to a lawyer would probably equal the cost of the cabinets, and then you would have to allege conduct to put you within the ambit of the statute...yup, slim and none.
