Legal Question in Bankruptcy in Illinois
I sold a house i owned in 05 in Indiana, the new owner went bankrupt, this year, now BOA is suing me because the new owners didn't make their payments , I got a summons but Im in Afghanistan. can they do this? And what do I have to do with the new owners going Bankrupt?

when you sold the house, you probably had a mortgage on it. it sounds like your sale was on contract and the mortage and note were not paid off when you closed. therefore you remained liable on the note/mortgage to BOA even though the new owners may have been making your payments. if you are in the service you may be immune for a period of time. you or someone on your behalf ought to contact a lawyer in the county where the suit was filed. hope this helps. good luck!
