Legal Question in Bankruptcy in Illinois
Can one spouse file for bankruptcy for obligations he incurred?
My husband has about $25k in credit card debt. These are individual accounts in his name only. I own a house that is just in my name. He has no assets in his name. Can he file for a Chapter 7 Bankruptcy as an individual and not have it affect our home since the title has always been held in my name alone?

Yes,He can file ch 7 / the Trustee will be very interested in why it was not in his name, but if it is not and has not ever been in his name, he is perfectly safe in filing chapter 7 bankruptcy, and your house is safe.
