Legal Question in Bankruptcy in Illinois

summons to appear in court.

I filed a voluntary bankrupty petition to the court on July 21, 2005 . I appeared to the trustee on August 24, but I recieved a summons to court 2 days before I appeared before the trustee by one of the creditors listed on my petition. The summons is for August 30, am I still to appear in court even though all of my creditors were notified before hand? I did not have Legal representation as I could not afford it.

To be on the safe side I would appear in court with proof of your bankruptcy filing and inform the judge of your bankruptcy. This way you no that no default judgment will be entered against you and the case can be closed.

I assume that if you filed a pro se petition, that you filed it over the public service counter. You should bring the stamped copy of the petition to court with you, to show the judge, and advise the judge and opposing counsel that a federal automatic stay is in effect. Good Luck! By the way, it pays to have legal counsel.
