Legal Question in Bankruptcy in Illinois
Time Limit to file
How long do I have to file court papers for a Charpter 7 Bankruptcy. I hired a lawyer in 2005 and and didn't file because I was scared that it would really hurt my credit now I am being sued, can I pay the court filing fees of $208 and finish filing or would I have to start all over again?

Re: Time Limit to file
The rules changed in October, 2005. Among other things, you have to do "Means Testing". You might not be eligible to file under Ch. 7 anymore. You should contact a BK lawyer immediately.
