Legal Question in Bankruptcy in Illinois
Time is running out, need answer fast
I filed chapter 7 a year and a half ago. Everything I filed on was discharged including GAL fees. The court case was still ongoing when I filed. I was forced to file at that time due to wage garnishments. On December 16th, 2002 the GAL took me to court for a judgement of his fees, which were partially discharged in bankruptcy court. The family law judge refused to deduct the amount filed and discharged on. He told me to take it to bankruptcy court. I have since hired an attorney in another area of our state that doesn't know bankruptcy laws but states that she is almost sure that if the case was still ongoing when I filed on him, that perhaps I don't owe this man anything. Where would I find this information out? I need answers quick as I only have 2 weeks left to file an appellate court appeal on this ruling. Which I intend to do. This attorney told me that she had a case one time where bankruptcy had been filed on GAL fees and when the case was finally closed the filer did not owe the GAL anything. Please help, time is running out

Since your time is running out, I would strongly suggest that you make an appointment with a bankrutpcy attorney who practices near your home and in the county in which the state law action has taken place, as soon as possible. GOOD LUCK!
