Legal Question in Bankruptcy in Illinois
Unable to pay back chapter 13
What will happen if my ex-husband can not pay his chapter 13 aggreement payment? Can the debitor come after me, if I am still a co-owner? I already have been to court with the debitor and then my ex-husband filed for chapter 13. He is now un-employed. A judgement without prejudice was given to me. Thank you

Re: Unable to pay back chapter 13
If the debtor is unable to pay into the Chapter 13 Plan, the Trustee will eventually file a motion to dismiss the case. In that instance, you will lose all protection afforded to co-signors.
