Legal Question in Business Law in Illinois
Attorney Not Filing Proper Incorporation Papers
My attorney and agent has not recorded the proper forms for renewal of my corporation. I now show as being dissolved, and my attorney/agent, after 12 months, finally admitted he did not file the papers and will have them reinstated. If he is indeed telling the truth, I do not feel that I am liable for the reinstatement fee of $600. Do I have any ramification against this attorney? Where can I complain?

If you feel you have been wronged by your attorney, file a complaint with the Attorney Registration and Disciplinary Commission (www.iardc.org). They will investigate the complaint and determine if your attorney committed any inpropriety.
Also, tell your attorney to eat the $600 himself.
Re: Attorney Not Filing Proper Incorporation Papers
I would send a letter to the attorney telling him or her that you do not feel that you should pay anything more than the renewal fee as the difference was due to his neglect. Ask for a written reply within 7 days. If that does not work, then you can report him to the Attorney Disciplinary Commission, and/or sue him in small claims court.
