Breech of contract
We recently had a corporation in which the two owners seperated. The contract terms are in question, whether or not they have been upheld on the part of the other party. We would like proof that the terms of the agreement were followed .Do we have the right to make him show proof that he is following the terms. If he is not or can not prove that he is, would that be concidered breech of contract and what would that entitle us to.

The answer to your question is quite fact-specific. In other words, what type of obligation do you question whether the other party is following, what does your contract say with respect to monitoring, what are the reasons why you suspect non-compliance? -- to name just a few factors.
The question you pose is not uncommon in executory contracts that you describe. Unfortunately, the ability to give any useful advice turns on obtaining more relevant facts.
