does a company have to resumit last year pay stubs to an employee

? If the company issued pay checks with stubs once, it would be up to the company to re-issue them.

Any attorney will say more information is needed. What do you mean by "resubmit?" Has the employee been given checks with pay stubs already? And a W2 for 2009? This should be sufficient. Consult with an attorney in your area for specific advice.

I am only guessing what you are after, but if you lost your paycheck stubs, you may be able to get replacements from the employer, but there may be costs to you involved in obtaining them.
