Legal Question in Business Law in Illinois
Delaware Corp DBA in Chicago--personal officer being sued
I incorporated in Delaware, live in Chicago, raised venture capital money to make a film in Chicago. I hired a manager who entered into agreements with all vendors who ended mismanaging money. anyway one vendor, who has agreed under her name and under my company, received 10,000 in payments and cashed checks right away when I had money in bank. Except, 3000 of that they decided to wait 2 months to cash after which point I had no money, it bounced. I had a default judgement entered against me personally even though I was never served and I am in process of reversing it. Given the facts, how can i get out of this as personal debt and make it coprorate or any other advice

Well, there are a few options. If you were never served, the judgment is defective and, therefore, unenforcible. On the other hand, you can seek to vacate the default judgment -- was it entered w/in the last 30 days??. Once done, you may move to dismiss the lawsuit on the grounds that they named the wrong defendant. In what county -- Cook? -- is the lawsuit pending?
