Where do I file a law suit for a bad deal on ebay, where I live or where the defendant lives.

Ebay has a set of rules. You should try following them first. Ultimately, if that does not work, you may be able to sue in either, but yo8u are more likely to collect on a judgment in the jurisdiction where the defendant is at, since that is where the assets are.
