Executed contract missing a date

The contract is missing the execution date. We wish to terminate but the terms are 60 days in advance of the then current term. We're past that window. Can we still terminate?

Generally, there may be other evidence that would show the execution date. However, I really dont see the connection between the execution date and the question about termination after the notice date. I don't think that the failure to have a date in the contract, in light of the performance is going to provide a loophole that will enable you to terminate. You might try bringing it up in an effort to negotiate a compromise. However, if the other party seeks legal advice I don't think it will get you anywhere.
