failure to deliver product in form and delivery

Our company contracted through RFP for a software product, design and implementation. We were to go from a dos database syst. to a web enabled system that allows our customers get the data we provide in a web enabled environment. The compamny has failed to deliver in the time frame, has not met its milestones, communicates horrendousley and has put our project months behind schedule. They now want extra houly fees because of "unaticipated changes and problems to both the web site design and backend functionality" which they designed and weve never approved. Is there anything i can do?

I suggest that you write RFP a letter

and advise them that you are cancelling your contract with them

based upon RFP's non-performance under

the terms of the contract. This letter should be mailed certified

(return/receipt). If they file suit,

you should file a counter suit. In

your letter you can also demand a

return of all money that you have paid

based upon RFP's non-performance and

then outline the money that your

company has lost due to the delay.
