Legal Question in Business Law in Illinois
Can they hold my paycheck?
I just quit a job where I was being harassed and degraded on a constant basis. When I started the owners were laughing about the last lady that quit and how they made her come in to get her last check over and over but wouldn't be there to give it to her. They said she made it hard on them so they were not going to make it easy for her. I have a feeling they are going to do this to me. Can they? And what can I do to prevent it?

Re: Can they hold my paycheck?
If they owe you the money, they have to pay you the money.
Any game playing on their part and your best bet is to either file a lawsuit or have an attorney send a letter threatening to file a lawsuit. If you know your bosses are in the building and just not coming to see you, you can always try asking the police to come - you are obviously concerned about abuse.
You have to decide how aggressive you want to be in getting the paycheck. I am sure part of the decision will be based on how much they owe you. Please feel free to give us a call if you want to talk.
