what can i do if my internet provider is consistatly less than 100% and still charges full price with no refund

If the provider is unwilling to provide you any rebate for poor service, you most likely have the option to cancel and then sue but if you don't have proof of the level of falloff in service beware the terms of service which are lengthy and may provide a defense. A judge may overlook them because they are usually huge and complex and one-sided, but maybe not. And if the provider has a right to any cancellation fees, they could sue you and then you'd have to defend. The best thought may be to just get their agreement for you to cancel without penalty, and find a provider that works for you.
