Legal Question in Business Law in Illinois
Labor law
How long after being fired from a job does the company have to pay me owed commissions. The company owes me $20,000 and he says if the work doesn't come in within 2 months he won't pay. He
started to say 3 months. Also if I
have to sue him can it be for 3X the amount + lawyers fees according to labor laws.

Re: Labor law
You have done your research well, correctly finding the Illinois Sales Representatives Act that provides for treble damages and attorney fees. If the sales have not come in yet, they do not yet owe you the commissions. If the sales come in after you are fired, you will have to prove that you caused the buyer to place the order, and even if you prove that you are probably not entitled to a commission if there is a really long delay. But I think 2 to three months is not long enough to let your employer off the hook, especially since you were fired, depending on the nature of your industry. Call me if you want to sue. Larry Stein.
