getting out of a lease due to misrepresentation
We signed a 5 year lease agreement about 11 months ago for a high speed, 4 color printer/copier. It was represented as the machine to cover our needs for our business.
We've had several service call that cost over $200 each time for repairs because we were printing on heavy stock, which we were told it was capable of using. After the first repair we were told the specs of the machine changed and we could no longer use the heavy paper stock.
Since we've had this machine and the print quality has steadily declined, we were told after the fact, that this should be expected. Several other major problems have occurred and continue to occur at substantial cost to us. We purchased the machine new, from a dealer but leased it through a leasing company.
Do we have any options for terminating this lease?

That's always a tough one. If it is actually a separate lease company, you're going to have a very difficult time extricating yourself. That would be tantamount to not making your house payments to the bank because the seller misrepresented the condition of the property. You might very well have a good cause of action against the seller of the machine.
