As the previous attorney mentioned, you would be filing a non-compete agreement. Depending on the circumstances you can get fairly substantial damages for these types of agreements because, theoretically, all of his customers could have been your customers.

Hello. If you discover that a former employee has violated the non-compete agreement, you can file a lawsuit against the former employee for breach of the contract. Such non-compete employment contracts are enforcible because a condition of the prospective employee being hired (consideration) is that the prospect agrees not to compete with the employer.
